DigitalJessica Ltd reserves the right to refuse service and/or access to its servers and/or services to anyone. This policy is only enacted in extreme circumstances in line with our Acceptable Use Policy and to maintain and protect the security of the DigitalJessica Ltd services.
We will endeavour to provide a continuous high-quality service. If you experience problems with your service, you should consult our support centre. Should you fail to find a resolution to your problem in our Knowledge Base you should email us or call our support line during office hours.
Please note we may require suspension of some of our services for short scheduled periods to carry out maintenance or repair to our services. Information concerning scheduled downtime is available on the DigitalJessica Ltd website, as are details of any interruptions to our services.
All hosting accounts are set up on payment in advance.
In situations where an invoice remains unpaid, DigitalJessica Ltd reserves the right to suspend all services until the outstanding debt is cleared. Any non-payment of an invoice may be subject to late payment penalty of 4% of any overdue invoice. The customer is responsible for all money owed on the account from the time the account was established to the time that the customer sends an electronic cancellation of the account via email.
All overdue accounts will be suspended after reasonable attempts have been made to contact you or your nominated representative. In addition, in the event that any amount due to DigitalJessica Ltd remains unpaid fourteen (14) days after such payment is due for shared hosting packages, seven (7) days for VPS and three (3) days for dedicated servers, DigitalJessica Ltd, in its sole discretion, may immediately terminate this agreement, and/or withhold or terminate Services. In the event of a termination, all data will be removed from our servers and we hold no liability to any losses incurred due to non-payment. We also reserve the right to charge a £12.00 fee to reinstate accounts that have been suspended or terminated.
You are always required to have a valid email address registered on your account, failure to do so may result in suspension of your account. We recommend having an email address not registered on the DigitalJessica servers so you can receive emails and status updates that might be affected by maintenance, outage, suspension or termination.
No bills or invoices will be sent by postal mail. All invoices will be sent directly to customers via email 14 days before they are due. Requests to alter a billing cycle must be received before an invoice is generated for the next billing cycle.
All payments will be conducted in GBP Sterling.
Your personal details
Please note that whilst your email is primarily used for billing purposes, DigitalJessica Ltd reserves the right to email you information about enhancements to our systems and important information. You must ensure that valid contact details, including your address and phone number always remain on the account. We reserve the right to suspend service if details are incorrect.
Bank Transfer / BACS:
DigitalJessica Ltd cannot guarantee that a service will be provided until after payment is received.
All PayPal payments are collected in GBP Sterling only. We do not use subscription-based PayPal payments, each payment must be initiated manually upon receipt of an electronically generated payment link. We accept the following major cards through PayPal: MasterCard, Visa, Electron, Maestro, Solo, JCB and American Express
Please note: We no longer accept payment by cheque or cash.
When possible, and upon request, we will transfer hosting accounts from an identical control panel. No fee is levied on transfers for up to 2 accounts.
Customers transferring an account must copy any content, emails and databases from another host manually if they are running a different control panel. If you need our assistance in doing so, you must contact us before the transfer to discuss your options.
Transfers away from DigitalJessica Ltd to another provider will only be processed if the account is not in arrears. DigitalJessica Ltd may at its sole discretion apply a fee for the transfer of accounts where our assistance is required.
Most services are setup within 60 minutes of payment being received. However, this sometimes can be longer. We quote up to 2 working days for setup of new orders.
Cancellation and refunds
DigitalJessica Ltd reserves the right to cancel a service at any time. In this event customers will be entitled to a prorata refund based upon the remaining period of membership. If a customer contravenes the terms of service a refund will not be issued in the event of a cancellation.
Domain names once registered cannot be refunded or cancelled at any point in time, for any reason. If you have a domain that is no longer required, you must let us know at least 15 days prior to the renewal date to cancel the service.
Customers may cancel their account at any time by giving 30 days’ notice to DigitalJessica Ltd. Fees charged on a prepay basis are non-refundable. Customers are not entitled to receive a refund unless the service is cancelled by DigitalJessica Ltd. In addition, some accounts incur set-up fees, these charges are also non-refundable.
A £12.00 per domain fee may be levied on certain transfers away from DigitalJessica Ltd where our assistance is required. Accounts must be up to date for any transfers to be processed.
All Hosting accounts are subject to a 30-day minimum, rolling contract. When a refund is due, these are processed within 30 days.
In the event of termination of this Agreement caused by your default hereunder, you shall bear all costs of termination, including any reasonable costs DigitalJessica Ltd incurs in closing your account. You agree to pay any and all costs incurred by DigitalJessica Ltd in enforcing your compliance with this Section. Upon termination, you shall destroy any copy of the materials provided to you hereunder and referenced herein. You agree that upon termination or discontinuance for any reason, DigitalJessica Ltd will delete all information related to you on the Services within 30 days.
Any customer reversing payments via bank, credit card (a “chargeback”) or PayPal (a “dispute”) may be subject to a punitive fee of £50, should the company deem this charge back to be unfair. The Company also reserves its right to defend such charge backs and recover the original monies from the client.
The customer agrees that it shall defend, indemnify, save and hold DigitalJessica Ltd harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against DigitalJessica Ltd, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless DigitalJessica Ltd against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with DigitalJessica Ltd services; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from a DigitalJessica Ltd server.
DigitalJessica Ltd will not be responsible for any damages or losses you may suffer. DigitalJessica Ltd makes no warranties of any kind, expressed or implied for services we provide.
DigitalJessica Ltd does back up your data and whilst every attempt would be made in the unlikely event of any corruption or hardware failure, DigitalJessica Ltd cannot guarantee to be able to replace all data. DigitalJessica Ltd expect all customers to maintain their own backup routine.
We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by DigitalJessica Ltd and its employees.
DigitalJessica Ltd reserve the right to revise its policies at any time. Continued use of the service constitutes acceptance of these terms.
